The Social Question, LLC (“@the_socialq) is committed to the protection and safeguarding of personal data collected from persons who are (a) clients or sponsors, (b) influencers or content creators, and (3) audience or followers participating in a question story box.
YOUR PRIVACY IS IMPORTANT TO US. The Social Question, LLC respects the privacy of all participants who respond to any form of our electronic information requests. To protect the identity and confidentiality of participants in our research studies, The Social Question, LLC does not resell or redistribute personal information about those who respond to our research studies.
Information we collect:
The information we collect may change from time to time based on the requirements of the research project. Here are some examples of information we will collect in order to determine if there is a partnership opportunity.
Question Sponsors:
Primary Contact Info such as name, email address, mailing address, phone numbers.
Business Related information to determine if your business meets the criteria of our research project such as objectives, background information, or other types of qualifying information.
Question Hosts:
Primary Contact Info such as name, email address, mailing address, phone numbers, including and not limited to: your social media handles, follower counts, and may request specific engagement statistics to determine partnership eligibility.
For both Question Sponsors and Question Hosts, we may also retain your Primary Contact Information for marketing and promotion efforts or to offer you a marketing research opportunity. You may remove yourself from this content at any time by “unsubscribing” at the bottom of the email communication or sending an email and express to be opted out to hello@the-socialq.com. Either of these actions will not and cannot prevent any automatic social media marketing to appear in your personal channels. If you wish to stop seeing any and all content related to The Social Question, LLC you must block the account from your own settings on your various social media accounts.
Question Participants:
For Question Participants (those who are responding to an Instagram Stories response box or feed post), we will collect your (1) social media handle via the Question Hosts contract and disclosure to their followers about the transaction, as well as the (2) response that you entered.
(1) Your social media handle is used to determine the Cash Giveaway winner. We use a random generated lottery system to make this selection. The winner will first be contacted via Instagram direct message from The Social Question, LLC account. Additional contact details in order to send payment may include social currency handles (e.g. PayPal, Venmo, Cashapp, etc.) or if preferring to receive payment by standard paper check, we may need to collect your mailing address and telephone number. For those participating and are not winners; we do not retain your social media handle names once winners have been informed and confirmed.
(2) Your response that you provide to a Question Host’s prompt will be used in data analytics as part of a marketing research endeavor. Your response(s) may be used both in the aggregate (compiled with other responses) and as part of a direct quote. You may even see your quote or response in marketing or advertising or promotional materials that The Social Question, LLC decides to release. Your response will not be shared with the Question Sponsor nor be mentioned publicly without written and expressed consent on behalf of the author.
If a Question Host fails to mention that your response and social media handle will be shared with The Social Question, their contract with The Social Question, LLC is considered void and we will not collect the responses and there will no Cash Giveaway awarded. A Question Host may mention it as speech, written text, and/or may include various hashtags as follows: #Partnership, #PaidPartnership, #Sponsorship, etc. to disclose the intent of your participation.
If a Question Participant is engaged on a public newsfeed post, The Social Question, LLC is not liable for any contact or connections made by others to the participant. In these cases of public engagement, please refer to Instagram’s policies if you feel someone has breeched your rights. (For your knowledge, most Influencer or Content Creator accounts are listed as public profiles.)
Finally, if any person decides to follow The Social Question, LLC (@the_socialq) on Instagram they agree they are doing so at their own free will. @the_socialq is a public business account. Please refer to Instagram’s policies for privacy related matters governing the use of their social site.
Data Security:
The Primary Contact Information mentioned above is typically retained for a period of 1 year from the date of your last participation and can vary based on obligations within our research projects and any ongoing Master Service Agreements (MSA). To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, we have put in place industry standard physical, electronic, and managerial procedures to help safeguard the information we collect.
Our sites are not intended for, or designed to attract, individuals under the age of 18. We do not collect personally identifiable information from any person we actually know is an individual under the age of 18 without explicit parental or guardian consent. Our sites do not accept any electronic payments for any services rendered.
The Primary Contract Information The Social Question, LLC collects is used to determine your eligibility for a marketing research partnership. Primacy Contact Information collected for Question Hosts is shared to Question Sponsors in limited capacity. Meaning; we will disclose your social media handle identity (which is standardly publicly available) and your name. If the Question Sponsor and Question Host wish to enter into their own marketing agreement after their experience with The Social Question it is the responsibility of the two parties to enter into their own new contract where additional details may be exchanged and not provided by The Social Question without written and expressed consent of either party.
The Question Participant information is shared to The Social Question as part of their paid contract agreement. The Social Question does not include Question Participant social media handles in their final data file deliverables nor analysis as part of any deliverable to the Question Sponsor.
The Social Question, LLC will not sell, distribute, or otherwise release personally identifiable information it collects to a third party without written and expressed consent. Notwithstanding the foregoing, if it becomes necessary by law or legal process for The Social Question, LLC to disclose your personal information, we may do so upon determination that such disclosure is legally necessary. In addition, in the event of The Social Question, LLC’s reorganization, merger, or sale, we may transfer any and all personal information to the relevant third party.
Privacy rights under the European data protection law (GDPR) include:
Transparency and the right to information. Through this policy we explain how we use and share your information. However, if you have questions or need additional information you can contact us any time.
Right of access, restriction of processing, erasure. You may contact us to request information about the personal data we have collected from you and to request the correction, modification or deletion of such personal information, which requests we will do our best to honor subject to any legal, ethical and contractual obligations. Right to withdraw your consent at any time:
When we process your personal data based on your consent, you have the right to withdraw it at any time. Right to object at any time. You have the right to object at any time to receiving marketing or promotional materials from us by either following the opt-out instructions in commercial e-mails or by contacting us, as well as the right to object to any processing of your personal data based on your specific situation. In the latter case, we will assess your request and provide a reply in a timely manner, according to our legal, ethical and contractual obligations. Some non-marketing communications are not subject to a general opt-out, such as communications about transactions and disclosures to comply with legal or ethical requirements.
Right to data portability. You have the right to data portability of your own personal data by contacting us.
Right not to be subject to an automated decision, including profiling. We do not make automated decisions using your personal data that may negatively impact you.
Right to lodge a complaint with a supervisory authority. If you consider that the processing of your personal data infringes your privacy rights according the European Privacy regulation, you have the right to lodge a complaint with a supervisory authority, in the member state of your habitual residence, place of work, or place of the alleged infringement.
Participation is voluntary and constitutes an independent contractor relationship, not an employment relationship.
